Terms and Conditions
These Terms and Conditions ("Terms") are an agreement between you and PardEats ("PardEats," "we," "us," or "our") that governs your access to and use of the PardEats website at pardeats.com (the "Site") and the PardEats mobile application (the "App," and together with the Site, the "Service"). By using the Service, creating an account, or tapping to agree during setup, you accept these Terms, our Acceptable Use Policy, and our Privacy Policy. If you do not agree, do not use the Service.
About PardEats
PardEats is a student project created by students at Lafayette College. It helps students and athletes plan campus and everyday eating around their nutrition goals, training, and recovery. We are not an incorporated company, and we do not sell any product, service, or personal information.
Not medical or professional advice
The Service is a wellness and nutrition tool. It does not provide medical, nutritional, dietetic, or other professional advice, diagnosis, or treatment, and it is not a substitute for guidance from a doctor, a registered dietitian, or your athletic trainer. Calorie and macro targets, recommendations, fueling guidance, readiness scores, and answers from the in-app assistant are general estimates for information only. Always seek the advice of a qualified professional before making decisions about your diet, training, health, or a medical condition, and never disregard professional advice because of something in the Service. If you have a medical emergency, call your local emergency number.
Allergens and nutrition estimates
Menu nutrition and allergen information is often estimated. General foods from public databases, and foods you add by scanning a barcode or nutrition label, are shown with unverified allergens, and scanned values can be incomplete or incorrect. You are responsible for confirming any allergy-critical information with dining staff or the product label before you eat. Do not rely on the Service to keep you safe from an allergen.
Eligibility and accounts
The Service is built for the Lafayette College community. During the alpha and beta, sign-up is open to anyone who wants to take part, and we may limit it again at any time. You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide, for keeping your sign-in credentials secure, and for activity that happens under your account. Tell us promptly if you believe your account has been used without your permission.
Device permissions
Some app features need your permission to use capabilities on your phone, such as the camera, photos and storage, notifications, and location. The App requests these when a feature needs them and explains why. You may grant or decline any permission and change your choice in your device settings; declining only disables the features that depend on it. How data from these features is handled is described in the Privacy Policy.
Your content
You keep ownership of the information and content you enter, such as your logs, custom foods, photos, and journal entries ("Your Content"). You grant us a limited license to store and process Your Content solely to operate the Service and provide its features to you. You are responsible for Your Content and confirm you have the right to provide it.
The in-app assistant and scanning
The in-app assistant generates responses using automated AI and can be wrong or incomplete. Treat its output as general guidance, not instructions, and confirm anything important. Barcode and label scanning fill in nutrition information that you must review and confirm before logging. Your use of these features is subject to our Acceptable Use Policy, and you are responsible for what you choose to log and act on.
Friends and shared meal status
If you use Friends, you can connect with people who share their friend code with you and share a temporary "eating now" status with the friends you accept. There is no student-to-student chat and no public feed. Only share a status you are comfortable sharing, use Friends respectfully, and do not use it to harass, track, or harm anyone. You can remove a friend, block a user, or clear your status at any time.
Acceptable use
You agree to use the Service only for lawful purposes and in line with our Acceptable Use Policy, which is part of these Terms. In summary, you agree not to break the law, provide false information or impersonate others, access accounts or systems you are not authorized to reach, disrupt or probe the Service, scrape or resell it, misuse the in-app assistant, or harass or harm another person. We may suspend or terminate access that we reasonably believe breaks these rules.
Intellectual property
The PardEats name, logo, and the Service's content and design are owned by the PardEats project and its student team, except for Your Content. We grant you a personal, limited, non-transferable, revocable license to use the Service for your own personal, non-commercial use. You may not use our name or logo without our written permission.
Third-party services
The Service relies on third-party services and may link to third-party content. We are not responsible for the content, policies, or practices of those third parties, and your use of them may be subject to their own terms.
Changes to the Service
PardEats is under active development. We may add, change, or remove features, and we may update the App. We may set or change usage limits to keep the Service running for everyone.
No warranty
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any estimate, recommendation, or nutrition or allergen value is accurate or complete, or that it will meet your goals.
Limitation of liability
PardEats is a free student project. To the fullest extent permitted by law, the project and its student team are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service, from reliance on any estimate, recommendation, or scanned value, or from any allergen or health outcome. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred US dollars (US $100).
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless the PardEats project and its student team from claims and expenses arising out of your misuse of the Service or your violation of these Terms or the Acceptable Use Policy.
Termination
You may stop using the Service and delete your account at any time from within the app, under More, then Account. We may suspend or end your access at any time, including for suspected misuse or to protect the Service or its users. Provisions that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, and indemnity, will survive.
Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-laws rules, except where the law that applies to you requires otherwise.
Changes to these Terms
Because PardEats is still in development, these Terms will change. When we make a meaningful change, we will update the date above and make you aware before it takes effect. Continued use of the Service after a change means you accept the updated Terms.
